If you have come to the United States seeking protection from persecution or torture in your country of origin, you may be eligible to apply for withholding of removal. An applicant must show that there is over a 50% likelihood of suffering persecution in the future to be granted withholding.
Withholding of removal is a form of relief from removal similar to asylum.
There are a few differences in definition and requirements for withholding of removal and asylum petition and proceedings. Like asylum, there must be a threat to life or freedom on account of:
- Race
- Religion
- Nationality
- Political opinion
- Membership in a particular social group
The main benefit of withholding of removal is that you get to stay and work in the United States. However, you may not apply for permanent resident status, you may not bring your spouse or children to the United States, and you may not travel outside of the United States.
If you are granted withholding of removal, you will have a final order of removal entered against you, which means that you will not be allowed to reenter the United States if you leave.
