U-Visa

A U Visa is offered to individuals who have been victims of a crime, and have assisted, are assisting, or will assist in the investigation and prosecution of the defendant, a suspect, or any other person who committed the crime.

U Visa Eligibility Criteria:

• You must have been a victim of a qualifying criminal activity, and this crime must have occurred in the United States or violated U.S. law.
• In the course of this criminal activity, you must have suffered substantial physical or mental abuse.
• You have useful information about this criminal activity.
• You have been or will be helpful to law enforcement to bring the perpetrator of this crime to justice.
• You are admissible to the United States, or you are applying for a waiver.

The first step in the U visa application process is completing Form I-918, Petition for U Nonimmigrant Status. When Form I-918 is submitted, an accompanying form, Form I-918, Supplement B, U Nonimmigrant Status Certificate must be submitted at the same time.

This second form certifies the applicant is a victim of a crime and has, is or will be providing assistance to law enforcement in the investigation of the crime.
